# THINK2SWITCH™ END USER LICENSE AGREEMENT (EULA) #### **PLEASE READ THIS END USER LICENSE AGREEMENT (“EULA”) CAREFULLY.** This EULA is a binding legal agreement between 14450949 Canada Inc., operating as Possibility Neurotechnologies (“Possibility Neuro,” “we,” “us,” or “our”), and you (“you” or “User”) regarding the Think2Switch™ software, including the mobile application, firmware, cloud services, and any future updates, upgrades, or versions thereof, together with all related documentation, guides, manuals, user interfaces, data services, and other materials provided in connection with the Think2Switch™ platform (collectively, the “Software”). By installing, downloading, accessing, or using the Software, you agree to be bound by this EULA. ### **IMPORTANT DISCLAIMERS** THINK2SWITCH IS NOT A MEDICAL DEVICE. Think2Switch™ is a consumer neurotechnology platform. The Software enables users to interact with digital and physical systems using brain-based input for entertainment, creative, accessibility, and general interaction purposes. The Software is not a medical device and is not intended for diagnosis, monitoring, or treatment of any medical condition, and it does not replace professional medical or therapeutic judgment. ### 1. License Grant Possibility Neuro grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on supported Apple devices, including iPhone, iPad, Mac, and other Apple platforms, solely in accordance with this EULA. The Software is licensed, not sold. ### 2. Proprietary Technology and Use Restrictions All aspects of the Think2Switch™ platform are proprietary to 14450949 Canada Inc., including but not limited to: the Software, algorithms, data models, system architecture, calibration processes, mental command and training methods, signal processing techniques, workflows, user interface and navigation design, user experience flows, instructional materials, documentation, tutorials, setup guides, and any other materials or methods used to operate or interact with the Think2Switch™ platform (collectively, the “Proprietary Technology”). You are granted a limited license to use the Proprietary Technology solely for its intended purpose while this Agreement is in effect. You may not, and may not permit any third party to: * Copy, reproduce, adapt, translate, or create derivative works based on the Proprietary Technology; * Attempt to replicate, reverse engineer, deconstruct, or imitate the Software, calibration processes, training methods, or system behavior; * Use the Proprietary Technology to develop, train, or improve any competing or substitute product, service, or system; * Extract or reuse any portion of the Software, documentation, workflows, or user experience for any purpose outside this Agreement; or * Provide access to the Proprietary Technology to any third party for the purpose of analysis, comparison, benchmarking, or replication. This restriction applies regardless of whether the copying or replication is performed manually, digitally, by software, by observation, or by any other means. All rights not expressly granted to you are reserved by Possibility Neurotechnologies Inc. ### 3. Data & User-Generated Information #### 3.1 Types of Data Think2Switch™ may process EEG signal data, configuration data, and app usage data to enable assistive interaction and product improvement. #### 3.2 Ownership & Licenses You own your personally identifiable data. You grant Possibility Neuro a perpetual, worldwide, royalty-free license to use de-identified and aggregated data for research, algorithm training, and commercial improvement of the platform. ### 4. Cloud & Connectivity Think2Switch™ performs real-time control locally on the device. With user consent and when connectivity is available, limited de-identified data may be transmitted to secure cloud services for quality improvement. ### 5. Safety Some users may experience discomfort, fatigue, or neurological symptoms when using screen-based or EEG-driven applications. If symptoms occur, stop using the Software and consult a professional. ### 6. Updates Updates may be provided automatically via Apple TestFlight or the App Store. ### 7. Termination This Agreement remains in effect until terminated. Possibility Neuro may terminate your license if you violate these terms or fail to maintain an active subscription. ### 8. Intellectual Property All intellectual property rights in the Software and Proprietary Technology belong to 14450949 Canada Inc. ### 9. Warranty Disclaimer The Software is provided “as is.” Possibility Neuro disclaims all warranties to the fullest extent permitted by law. ### 10. Limitation of Liability Possibility Neuro shall not be liable for indirect or consequential damages. Total liability shall not exceed the fees paid in the prior 12 months. ### 11.
